Item A POSSIBILIDADE DA REVOGAÇÃO DA LEI DE ALIENAÇÃO PARENTAL(2024-11-08) MARIA JULIA ZANUTIM BERNARDOParental alienation is a complex phenomenon that has harmed the bond between children and their parents, often in custody disputes. The objective of this article was to explore the effects of revoking the Parental Alienation Law, addressing legal and procedural issues as well as the reconstruction of family relationships post-divorce. The justification was based on the need to protect children's rights and promote healthy family relationships, aligned with the principle of the best interests of the child. A basic-applied methodology was employed, with a qualitative approach that allowed for the development of new ideas on the topic. The deductive-hypothetical method tested hypotheses through the analysis of judicial decisions, focusing on at least three relevant case laws. The research included monthly searches for case law and a review of pertinent literature. The expected results stimulated debate on the effectiveness of the Parental Alienation Law, highlighting the need for a more flexible approach to custody and family relationships. Furthermore, the importance of policies promoting healthy co-parenting was emphasized, aiming to reduce family conflicts without relying solely on specific legislation. In conclusion, proposals emerged for the revision or revocation of the law, seeking more holistic and effective approaches to protect children's rights and promote healthy family relationships.
